Moody At Work LLC (“Moody At Work,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when your organization subscribes to Moody At Work’s application and related services (collectively referred to as the “Service”). By using the Service, you acknowledge that your organization has provided your email for access and that you agree to the terms of this Privacy Policy. Your organization is responsible for obtaining any necessary permissions from employees before providing us with their information.   

1. Information We Collect

 

1.1 Organizational Sign-Up and User Profiles: Organizations subscribe to Moody At Work and provide us with employee emails for account creation. Users may update their profile details, including name, job title, and company information.

1.2 Usage Information: We collect information about how users interact with the Service, including application usage patterns, features accessed, and other analytical data.

1.3 Anonymized Mood and Productivity Data: Moody At Work collects mood and productivity data. This data is rigorously anonymized to prevent individual identification. This process includes removing or altering any data that could directly or indirectly link inputs to specific users.

1.4 Cookies and Tracking Technologies: We may use cookies and similar tracking technologies to enhance user experience and gather usage statistics. You can control cookie preferences through your browser settings.   

2. How We Use Your Information

2.1 To Provide the Service: We use the information we collect to deliver, maintain, and improve the Moody At Work application and associated services. This includes personalizing the user experience, troubleshooting issues, and generating aggregated reports.

2.2 Communications: We may use the provided contact information to communicate about the Service, including updates, announcements, and relevant subscription details.

2.3 Data Retention: We retain user information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, or as required by law. Specifically: 

  • Account details are retained for the duration of the organization’s subscription and for a period of 90 days after subscription termination, unless required otherwise by law. 
  • Anonymized mood and productivity data may be retained for longer periods for research and analytical purposes. 
  • We follow data minimization principles and only retain data that is required to provide the service.   

2.5 Data Usage and Non-Marketing: Moody At Work is committed to protecting your privacy. We do not sell your personal data to any third parties. The information we collect is used solely for the purpose of providing, maintaining, and improving the Moody At Work Service. We do not use your data for direct marketing purposes.

 

3. Information Sharing

3.1 Third-Party Service Providers: We may engage third-party service providers to assist in delivering the Service. This includes platforms like Stripe & Mercury for payment processing and financial operations, and Apple, Android, and Microsoft for running our application across various devices. These third parties only access information necessary for their services, such as payment data for Stripe or email addresses for Microsoft Entra Single Sign-On functionality. 3.3 Data Access:

  • Assigned administrators of subscribing organizations can access aggregated data through the web dashboard.
  • Individual users receive private reports for their own use.
  • Moody At Work employees may access data for compliance, awarding, and app improvement purposes, always adhering to strict privacy and security protocols.

4. Data Security

4.1 Security Measures: We employ industry-standard security measures, including encryption, firewalls, secure socket layers (SSL), and the security infrastructure of Microsoft Azure, where our data is securely hosted, to protect your information from unauthorized access, disclosure, alteration, or destruction.

4.2 Data Breach Response: In the event of a data breach, Moody At Work will notify affected organizations promptly and take steps to mitigate the breach, including working with law enforcement if necessary. Critically, even in a breach scenario, the anonymization of mood and productivity inputs ensures that individual users cannot be identified from their data.

5. User Choices

5.1 Opt-Out: Users may opt out of receiving promotional communications from Moody At Work by following the unsubscribe instructions provided in the communication or contacting us at info@moodyatwork.com.

5.2 Access and Correction: Users who need to update or correct their personal information must do so through their organization, which will facilitate the request.

5.3 Right to Erasure (Right to be Forgotten): Requests for data deletion must be submitted through the subscribing organization, which will coordinate with Moody At Work to process such requests.

6. Data Transfers and International Users

If accessing the Service from outside the United States, user information may be transferred to, stored, and processed in the United States, where Moody At Work’s servers, hosted on Microsoft Azure, are located. We take steps to ensure compliance with applicable data protection laws.

7. Children’s Privacy

The Service is not intended for children under 13 (or the applicable age in your jurisdiction). We do not knowingly collect personal information from children. If we become aware that a child has provided us with personal information, we will take steps to delete such information.   

8. State-Specific Rights

Depending on your state of residence, you may have additional rights under applicable state privacy laws, such as the California Consumer Privacy Act (CCPA).

9. Data Controller/Processor

Moody At Work acts as a data processor for the mood and productivity data, and a data controller for account and contact information.

10. Changes to this Privacy Policy

We reserve the right to update this Privacy Policy. Any changes will be effective immediately upon posting. We will notify users of significant changes via email or in-app notifications. Continued use of the Service constitutes acceptance of the updated Privacy Policy.  

11. Data Provision and Anonymity Priority:

11.1. Organizational Data Provision: Moody At Work operates on the basis of data provided by subscribing organizations. Specifically, organizations provide employee email addresses and, optionally, employee names for the purpose of account creation and user verification.

11.2. User-Provided Data: Users have the option to enhance their profiles by providing a display name and uploading a profile photo.

11.3. Email Address Necessity: The provision of a valid email address is a mandatory requirement for the operation of the Moody At Work Service. Without a valid email address, the Service cannot function, and accounts cannot be created or accessed.

11.4. Anonymity as Core Principle: Moody At Work’s core principle is the preservation of user anonymity in relation to mood and productivity data. No rights or support will be provided that would compromise this principle.

11.5. Overriding Clause: This Clause 11 shall supersede and override any other clause or provision within this Privacy Policy or any other agreement between Moody At Work and its users or subscribing organizations, to the extent that any conflict or inconsistency arises. Specifically, the necessity of email address provision for operational purposes and the absolute commitment to user anonymity shall prevail in all circumstances.
